The aftermath of the Corona crisis, the war in Ukraine and imploding energy prices mean that we live in a new reality, in which labor costs and operating costs, related to real estate, rental rates, gas and electricity, are very high.
A survey among the 195 ACC members shows that only 17% of the agencies have an indexation clause in the majority of their contracts. These agencies are entitled to invoke the price review clauses as formulated in their contract to meet inflation. Insofar as this can be concretely demonstrated on the basis of objective parameters and objective costs.
The same survey shows that 1 in 4 agencies is hesitant to pass on any form of indexation to its customers. However, the absence of a price revision clause in the contract between the client and the agency does not mean that no price revision can be made at all.
The following elements are important:
The parties must always perform the contract in good faith. This means that: if the principal automatically refuses any renegotiation of a price revision (despite today's specific financially difficult circumstances), thereby jeopardizing the economic equilibrium between the parties, the principal is failing to act in good faith. Which includes a contractual error.
The new contract law will come into effect on January 1, 2023. Contracts that are concluded afterwards can, subject to the fulfillment of the conditions attached thereto, from then on be adjusted or renegotiated on the basis of the concept of "changed circumstances" at the request of one of the parties, if new circumstances have arisen since the conclusion of the contract that prevent the execution of the contract. of the contract would be “unreasonable”.
This would thus mean that an increase in the hourly rates could be implemented because of the high costs that – difficult – can only be borne by the agencies.
The expected salary increase and rising costs are putting pressure on the prospects and scope for growth and innovation of all parties. ACC relies on the good relationship between clients and agencies and on the recognition of the added value of the agencies by the clients, to open up this delicate matter for discussion.
De nasleep van de Coronacrisis, de oorlog in Oekraïne en de imploderende energieprijzen, maken dat we in een nieuwe realiteit leven, waarin loonkosten en functioneringskosten, verbonden aan onroerend goed, huurtarieven, gas en elektriciteit, erg de hoogte in gaan.
Uit een rondvraag onder de 195 ACC-leden blijkt dat slechts 17% van de agentschappen een indexatieclausule in het merendeel van hun contracten hebben voorzien. Deze bureaus zijn gerechtigd om beroep te doen op de prijsherzieningsclausules zoals geformuleerd in hun contract, om tegemoet te komen aan de inflatie. Voor zover die concreet kan worden aangetoond op basis van objectieve parameters en objectieve kosten.
Dezelfde rondvraag leert dat 1 op 4 agentschappen schroom heeft om welke vorm dan ook van indexatie door te rekenen aan haar klanten. Wanneer er geen prijsherzieningsclausule bestaat in het contract tussen de opdrachtgever en het agentschap, betekent dit echter niet dat er helemaal geen prijsherziening kan worden doorgevoerd.
Volgende elementen zijn belangrijk:
Partijen dienen het contract steeds te goeder trouw uit te voeren. Dit wil zeggen dat: indien de opdrachtgever elke heronderhandeling over een prijsherziening automatisch weigert (ondanks de specifieke financieel moeilijke omstandigheden van vandaag), waardoor het economisch evenwicht tussen partijen in gedrang komt, de opdrachtgever nalaat te goeder trouw te handelen. Hetgeen een contractuele fout omvat.
Op 1 januari 2023 treedt het nieuwe verbintenissenrecht in werking. Contracten die nadien worden afgesloten kunnen, mits vervulling van de hieraan verbonden voorwaarden, vanaf dan op basis van het concept “veranderde omstandigheden” worden aangepast of heronderhandeld op vraag van één van de partijen, indien zich sinds de contractsluiting nieuwe omstandigheden hebben voorgedaan waardoor de uitvoering van het contract “onredelijk” zou zijn.
Dit zou aldus betekenen dat een verhoging van de uurtarieven kan worden doorgevoerd omwille van de hoge kosten die – moeilijk – alleen kunnen worden gedragen door de agentschappen.
De verwachte salarisstijging en de stijgende kosten zetten het perspectief en de ruimte voor groei en innovatie van alle partijen onder druk. ACC vertrouwt op de goede verstandhouding tussen opdrachtgevers en agentschappen en op de erkenning van de toegevoegde waarde van de agentschappen door de opdrachtgevers, om deze delicate materie bespreekbaar te maken.

After all, the Covid crisis has shown that we as an event sector are much too fragmented and therefore find less audience with political authorities than the popular festival, culture and sports sector.
With the establishment of Event Confederation, an initiative of ACC, BESA and Febelux, we now have an umbrella trade association for the first time, with which we come out as one voice.
As a result, we are now being heard and many of the current support measures for the event agencies - including yours - are a direct result of Event Confederation's ongoing lobbying work.
The next step is the recognition of EC as an official Belgian employers' organization, with a view to setting up our own Joint Committee for our sector.
This can only happen if we put in sufficient weight and all associations under EC are sufficiently representative of their field, in terms of number of companies and employees.
Hence this call: by joining ACC, you strengthen the power of EC as a lobby device and we can act as one block, one strong sector.

ACC is de vakvereniging van de Belgische communicatiebureaus, inclusief de eventbureaus. Sinds de start van de Covid-19 crisis, heb jij er als eventbureau meer dan ooit baat bij om lid te worden van het Expert Center Event Marketing van de Association of Communication Companies.
Waarom nu lid worden?
De Covid-crisis heeft immers aangetoond dat wij als eventsector veel te versnipperd zijn en daardoor minder gehoor vinden bij politieke instanties dan de populaire festival-, cultuur- en sportsector.
Door de oprichting van Event Confederation, een initiatief van ACC, BESA en Febelux,hebben we nu voor het eerst een overkoepelende vakorganisatie, waarmee we als één stem naar buiten komen.

Dit kan enkel gebeuren wanneer we voldoende gewicht in de schaal leggen en alle verenigingen onder E-C voldoende representatief zijn voor hun vakgebied, op het vlak van aantal bedrijven en werknemers.

The Event Confederation is therefore very pleased that this restriction is now being addressed and that the banks are allowing for additional deferral of capital repayment for companies for an additional 6 months until the end of June 2021.
In the event sector, 7 out of 10 companies had already met the 9-month maximum term since the beginning of this year. This, in combination with a long-term mandatory closure and therefore no turnover, could only cause major problems in terms of liquidity and cause permanent major damage.
It is very good news that Minister Vincent Van Peteghem and the banks are now making an extra term of 6 months possible for healthy companies and, moreover, without any file or administration costs.
Bruno Schaubroeck: Our complaints were clear and we appreciate the support and solidarity from the financial sector. There was good consultation with the Minister and Febelfin, with a lot of understanding and willingness to listen on both sides, but above all with a positive outcome for our companies. For many of our companies, this charter is the difference between getting through the crisis or not. The next step is to get the sector back to work. We ask the government for perspective and appreciation from society for our efforts as a sector in the public interest.

De Event Confederation is bijgevolg zeer verheugd dat deze beperking nu wordt aangepakt en dat de banken extra uitstel van kapitaalsaflossing voor ondernemingen mogelijk maken voor 6 extra maanden tot einde juni 2021.
In de eventsector waren 7 op de 10 bedrijven sinds begin dit jaar al aan de maximumtermijn van 9 maand. Dat in combinatie met een langdurige verplichte sluiting en dus geen omzet, kon dit enkel voor grote problemen zorgen qua liquiditeit en blijvende grote schade veroorzaken.
Dat Minister Vincent Van Peteghem en de banken nu voor de gezonde bedrijven een extra termijn mogelijk maken van 6 maanden en daarenboven zonder dossier- of administratiekosten is zeer goed nieuws.
Bruno Schaubroeck: Onze verzuchtingen waren duidelijk en we appreciëren dan ook de steun en solidariteit vanuit de financiële sector. Er was goed overleg met de Minister en Febelfin, met veel begrip en luisterbereidheid van beide zijdes, maar vooral met een positieve outcome voor onze bedrijven. Dit charter is voor veel van onze bedrijven het verschil tussen door de crisis geraken of juist niet. De volgende stap is nu terug de sector aan het werk krijgen. We vragen van de regering perspectief en van de maatschappij waardering voor onze inspanningen als sector in het maatschappelijk belang.

Throughout the months and various measures, many players were systematically left out or the amounts were not adjusted. Often not consciously, but a consequence of a difficult definition of the entire event sector.
The globalization premium with which the sector was involved solves this a great deal. Minister Crevits is now giving companies - often international standard-bearers - a clear option for a future through appropriate necessary support from Flanders.
The extension of the Flemish Protection Mechanism is of course also positive. Companies can count on Flanders' commitment to further support until the end of February 2021. This gives peace of mind to the entrepreneur.
The next step for the event industry is to avoid a third wave at all costs and therefore remind everyone of their responsibility. The rules are there for everyone. Spokesperson Bruno Schaubroeck points out that the virus is not circulating through catering establishments or schools or fitness clubs or whatever, but only through people's behavior. Our behavior! Failure to comply is no more or less than playing with the future of our entrepreneurs. Celebrate Christmas and New Year, but with respect for all rules, only then is a somewhat normal summer 2021 conceivable. Each of us has that choice.
The sector has always indicated that it wants to get out of this crisis while working and hopes to be able to do so (cautiously) in 2021, with prospects for the summer.
It will be difficult weeks and months, but with constructive consultation and a positive outlook, the sector hopes to really be able to bring people together again in 2021.
De globalisatiepremie van Minister Crevits en de voltallige Vlaamse Regering maakt het verschil tussen elke morgen bang naar de bankrekening kijken of voorzichtig naar de toekomst te durven kijken. De Vlaamse Regering kiest duidelijk voor een Vlaamse eventsector na covid-19.
Doorheen de maanden en verschillende maatregelen vielen tal van spelers systematisch uit de boot of waren de bedragen niet aangepast. Vaak niet bewust, maar een gevolg van een moeilijke definiëring van de gehele eventsector.
De globalisatiepremie waar de sector mee bij betrokken werd, lost dit een groot stuk op. Minister Crevits geeft nu de bedrijven - vaak internationale vaandeldragers - een duidelijke optie op een toekomst door aangepaste noodzakelijke steun vanuit Vlaanderen.
De verlenging van het Vlaamse Beschermingsmechanisme is uiteraard ook positief. Bedrijven kunnen rekenen op het engagement van Vlaanderen voor verdere steun tot einde februari 2021. Dit geeft gemoedsrust aan de ondernemer.
De volgende stap voor de eventsector is koste wat kost een derde golf te vermijden en wijst iedereen daarom op zijn verantwoordelijkheid. De regels zijn er voor iedereen. Woordvoerder Bruno Schaubroeck wijst erop dat het virus niet circuleert door horeca of scholen of fitnessclubs of wat dan ook, maar enkel en alleen door het gedrag van mensen. Ons gedrag! Niet naleven is niet meer of minder dan spelen met de toekomst van onze ondernemers. Vier Kerst en Nieuwjaar, maar met respect voor alle regels, alleen zo is een enigszins normale zomer 2021 denkbaar. Die keuze heeft elk van ons.
De sector heeft altijd aangegeven werkend uit deze crisis te willen geraken en hoopt dat (voorzichtig) in 2021 te kunnen doen, met perspectief voor de zomer.
Het worden nog moeilijke weken en maanden, maar met constructief overleg en een positieve blik hoopt de sector mensen terug écht te mogen samenbrengen in 2021.

A clear, good and necessary step for our hard hit sector.
For our sector, however, the end of the moratorium on capital repayment is an outlaw. The moratorium will be extended by 3 months until the end of March 2021, but there is a limit of 9 months. Because our sector has been unable to achieve a single Euro in turnover from mid-March, many companies are already at the 9-month limit by the end of December.
This limit is imposed by the EBA and must be observed by the Belgian government, but it declares our event entrepreneurs outlaws. The banks hold the key.
If no acceptable guarantees are mentioned, the domino effect will be enormous. Companies will drag each other into bankruptcy.
A moratorium tailored to the entrepreneur, who has often been a customer of the bank for years, is permitted and is absolutely necessary. Today, business leaders still have to sit down with their banker to thoroughly work out their file.
Schaubroeck: Febelfin is committed to looking at the healthy companies of February 2020 and not at the current difficult situation that event companies find themselves in. We call on the bankers to make this happen in the discussions they will have with the individual event entrepreneur.
Event Confederation wants to expressly point out to the banks their social responsibility. The banks want it on an individual basis, it is now up to the banks to show that they are worthy of that trust. Events are often used by the banking sector to support their image or customer relationships. Now we are counting on them to save this pre-covid very healthy sector.
We call on the Belgian government and in particular Prime Minister De Croo & Minister Vincent Van Peteghem to bring our sector and the banks together for a further structural

Voor onze sector is het einde van moratorium van de kapitaalaflossing echter een vogelvrij- verklaring. Het moratorium wordt verlengd met 3 maand tot eind maart 2021, maar er is een limiet van 9 maanden. Doordat onze sector reeds van midden maart geen enkele Euro omzet meer heeft kunnen boeken, zijn veel bedrijven eind december reeds aan de limiet van deze 9 maanden.
Deze limiet is opgelegd door de EBA en dient de Belgische overheid na te leven, maar deze verklaart onze eventondernemers vogelvrij. De banken hebben de sleutel in handen.
Indien er niet over aanvaardbare waarborgen gesproken wordt zal het domino-effect enorm zijn. Bedrijven zullen elkaar meesleuren in hun faillissement.
Een moratorium op maat van de ondernemer, vaak al jaren klant bij de bank, is toegestaan en is ten zeerste noodzakelijk. Bedrijfsleiders dienen vandaag nog met hun bankier aan tafel te schuiven om hun dossier grondig uit te werken.
Schaubroeck: Febelfin engageert zich om te kijken naar de gezonde bedrijven van februari 2020 en niet naar de actuele moeilijke situatie waar eventbedrijven zich in vinden. Wij roepen de bankiers op dit waar te maken in de gesprekken die zij aan zullen gaan met de individuele event-ondernemer.
Event Confederation wil de banken zeer uitdrukkelijk op hun maatschappelijke verantwoordelijkheid wijzen. De banken willen het op individuele basis, het is nu aan de banken om te tonen dat ze dat vertrouwen waard zijn. Events worden door de bancaire sector vaak ingezet voor de ondersteuning van hun imago of klantenrelaties. Nu rekenen wij op hen voor deze – pre covid kerngezonde - sector te redden.
Wij roepen de Belgische regering en meer bepaald Premier De Croo & Minister Vincent Van Peteghem op om onze sector én de banken samen aan tafel te zetten voor een verdere structurele

The event agencies, their suppliers and partners need their own liquidity to bridge the coming months. They have invested a lot of their own resources in your events in recent months. A quick payment of the outstanding invoices for realized events will now give the sector oxygen! Can we count on this? Force majeure may not be a warrant to cancel contracted events. It is essential that all parties involved make every effort to minimize the dire consequences of the Corona crisis. Unless this would be impossible for very specific and well-founded reasons, the planned, contracted events that were canceled due to force majeure should be moved and preferably to a later date in 2020. Maintaining the turnover lost due to force majeure in 2020 gives the sector soon the necessary oxygen! If the customer makes the sovereign decision to cancel the event without postponement, we insist that the delivered and proven performance can be invoiced and the costs incurred recovered. De actuele crisis mag onder geen enkel beding een reden zijn om betalingen structureel te vertragen.
De eventbureaus, hun leveranciers en partners hebben nood aan hun eigen liquide middelen om de komende maanden te overbruggen. Veel van die eigen middelen hebben ze de afgelopen maanden geïnvesteerd in jullie events.
Een snelle betaling van de openstaande facturen voor gerealiseerde events zal de sector nu zuurstof geven!
Kunnen wij hierop rekenen?
Overmacht mag geen vrijgeleide zijn om gecontracteerde events te annuleren.
Het is van essentieel belang dat alle betrokken partijen alles in het werk stellen om de zware gevolgen van de Coronacrisis tot een absoluut minimum te beperken.
Behoudens het geval dit om zeer specifieke en gegronde redenen onmogelijk zou zijn, dienen de geplande, gecontracteerde events die door overmacht werden geannuleerd te worden verplaatst en bij voorkeur naar een latere datum in 2020. Het behoud in 2020 van de door overmacht verloren omzet geeft de sector straks de nodige zuurstof!
Indien de klant de soevereine beslissing neemt om het event alsnog te annuleren zonder verschuiving, vragen wij met aandrang dat de geleverde en bewezen prestaties kunnen worden gefactureerd en de gemaakte kosten gerecupereerd.
Kunnen wij hierop rekenen?
De actuele steunmaatregelen van de overheid bieden vandaag wat soelaas ...

Dear Professors, Ladies and Gentlemen Ministers You cannot imagine the impact your decision will have on the 80,000 people in our sector. After more than 120 days without perspective, the anxiety turns into desperation, that is the step for anger. That anger would be justified even now. We see our precious event sector sacrificed in function of other sectors. People are allowed to travel back at the request of the tourism sector, but we as the event sector are victims of this decision. We cannot accept this. We check the visitors of our events at the entrance, and not at the exit! Wouldn't it be more logical to check travelers entering Belgium instead of those leaving. Or just forbid people to leave, that prevents the import of the virus and increases the tourism income for our country. We will soon have to watch with sorrow how a multitude of people in the shopping streets will mingle on 'bargain hunting'. And afterwards you will lock us up even more as an event sector because of 'the increased figures'. Shops, shopping centers and airports have less efficient crowd control, zoning, time slots than our events. We do not have to analyze other sectors, but in our sector we can inform you that safety, crowd control and anticipation are second nature. Safety is central in our sector and in our training. Then why do you distrust our sector? Because one man in Puurs has behaved outright scandalous? Dear Doctors, As a doctor, you also have a responsibility for the economic well-being of your 'patients'. A patient who asks you 'when will I be able or allowed to go back to work' does not need a medical answer but a perspective, an honest answer, a mental and realistic boost. With 80,000 men and women, 3,000 companies, we are your 'patients', so big but also concrete is your 'power'. You can hardly blame us, after 120 days almost the entire Belgian industry, retail, schools, catering and others has been restarted. We ask again - with urge and respect - a physical live meeting, with face masks and with our people around the table, on location, date and time of your choice. But with sufficient time to discuss all questions from our sector structurally and pragmatically. Questions about tomorrow, about the summer, but also for September / October / November / December and 2021. Let us thoroughly discuss all scenarios immediately. Our job is planning and organizing, let us immediately discuss the scenarios for 2021. Dear Politicians, Belgium can make good use of our more than 80,000 manpower, our sector was very healthy, profitable and dynamic. World players who often give you a stage. Dames en Heren Ministers
U kan zich niet inbeelden welke impact uw beslissing heeft op de 80.000 mensen in onze sector.
Na meer dan 120 dagen zonder perspectief slaat de onrust om in radeloosheid, dat is de stap voor woede.
Die woede zou zelfs nu reeds terecht zijn.
Wij zien onze dierbare eventsector opgeofferd in functie van andere sectoren.
Mensen mogen terug reizen op vraag van de toeristische sector, echter wij als eventsector zijn slachtoffer van deze beslissing. Wij kunnen dit niet aanvaarden.
Wij controleren de bezoekers van onze events aan de ingang, en niet aan de uitgang !
Zou het niet logischer zijn om reizigers die België binnen komen te controleren ipv diegene die vertrekken.
Of verbied gewoon mensen om te vertrekken, dat voorkomt de import van het virus en verhoogt de toeristische inkomsten voor ons land.
Wij zullen binnenkort met lede ogen moeten toezien hoe een massa mensen in de winkelstraten door elkaar zal lopen op ‘koopjesjacht’.
En nadien zal u ons als eventsector nog meer opsluiten omwille van 'de verhoogde cijfers’.
Winkels, shoppingcentra, luchthavens hebben minder efficiënte crowd-control, zonering, timeslots dan onze events.
Wij moeten niet de analyse maken van andere sectoren, maar in onze sector kunnen we u meegeven dat veiligheid, crowd control en anticiperen een 2° natuur is.
'Safety' staat centraal in onze sector en in onze opleidingen.
Waarom wantrouwt u onze sector dan ? Omdat er één onverlaat in Puurs zich ronduit schandalig gedragen heeft ?
Beste Artsen,
U hebt als arts ook een verantwoordelijkheid over het economisch welzijn van uw ‘patiënten’.
Een patiënt die u vraagt ‘ wanneer zal ik terug mogen of kunnen gaan werken’ heeft geen medisch antwoord nodig maar een perspectief, een eerlijk antwoord, een mentale en realistische opkikker.
Wij zijn met 80.000 mannen en vrouwen, 3000 bedrijven uw ‘patiënten’, zo groot maar ook concreet is uw ‘macht’.
U kan ons geen haast verwijten, na 120 dagen is zowat de hele Belgische industrie, retail, scholen, horeca ea heropgestart.
Wij vragen nogmaals - met aandrang en respect - een fysieke live meeting, mét mondmaskers én met onze mensen rond tafel, op locatie, datum en uur naar keuze.
Maar met voldoende tijd om alle vragen van onze sector structureel en pragmatisch door te spreken.
Vragen over morgen, over de zomer, maar ook voor september/oktober/november/december en 2021.
Laat ons onmiddellijk grondig alle scenario’s bespreken. Onze job is plannen en organiseren, laat ons maar onmiddelijk de scenario’s voor 2021 ook overleggen.
Beste Politici,
Belgie kan onze meer dan 80.000 arbeidskrachten goed gebruiken, onze sector was kerngezond, winstgevend en dynamisch. Wereldspelers die u vaak een podium geven.
Beurzen en congressen voor dit najaar worden verplaatst naar steden als Breda en Rijsel, simpelweg omdat de overheid in die landen structureel wél inzicht heeft in de belangen van deze sector.
Binnenkort zullen Belgen massaal naar concerten in het buitenland trekken.
Zelfs de Belgische bedrijven uit onze sector zullen in het buitenland vlugger aan het werk kunnen gaan dan in hun ‘Homeland’.
De kabinetten hebben ons de laatste weken uitstekend geholpen.
De dossiers liggen op tafel.
Het CERM-model werkt en kan aangepast worden.
Meer dan 14.000 simulaties in minder dan 2 weken werden door de sector gedaan.
Enkel met vertrouwen en respect geraken we vooruit.
Met inzicht en overleg.
Met goede afspraken. Zelfregulerend.
Politici u dient zich nu te engageren tov onze sectoren.

Jullie dienen verschrikkelijk vermoeid te zijn na deze gigantische - én complexe - opdracht in functie van het welzijn van ons land, wij respecteren dit.
Wij willen hier al werkend uit geraken.
Wij zullen als sector met heel concrete vragen aan tafel schuiven.
Wij bereiden deze paper voor.
Realistisch, ambitieus maar ook verantwoordelijk.
